To cover the full scope of managing restaurants, Positeasy offers certain add-ons that can be availed through our secure online payment gateway. Below are the Terms and Conditions governing these services:

Introduction

These Terms of Service ("Terms") outline your legal rights and responsibilities when accessing or using the website at www.positeasy.com ("Site") and any related mobile or software applications provided by Positeasy ("the App"). By downloading or using the App, you agree to these Terms, the Privacy Policy, and the License Agreement.

If you have any questions about these Terms, please contact us using the information provided at the end of this document. If you disagree with any part of these Terms, please stop using the App immediately.

Definitions

Services: Includes applications such as Feedback Management and Waiting Queue Management, integrated with the Positeasy POS system.
Content: Refers to materials created by Positeasy, including visual elements, interactive features, software, and aggregate data related to your account.
User Content: Refers to any content you upload or share via the App, such as reviews, images, customer details, or table usage data.

General Rules of Conduct

Positeasy grants you a personal, non-transferable license to use the App and Services solely as described in these Terms. You agree to:

Use the Services in compliance with applicable laws.
Avoid any unauthorized access or tampering with the App.
Refrain from activities such as copyright infringement or reverse engineering.

You indemnify Positeasy against any loss or damage resulting from the misuse of the App or violation of these Terms.

Intellectual Property

Positeasy owns all intellectual property rights to the Services and Content. By submitting User Content, you grant Positeasy a perpetual, royalty-free license to use your content for any purpose, including partnerships with third parties. You remain responsible for the accuracy and legality of your content.

Positeasy is not liable for third-party content or external links. We are also not responsible for any loss or damage resulting from reliance on third-party information.

Free Trial and Fees

The App offers a free trial for one week unless otherwise specified. At the end of the trial, your selected payment method will be charged for a yearly subscription unless canceled.

Membership fees are non-refundable, even for partial periods.

Positeasy reserves the right to modify pricing and service plans at any time.

We take your privacy seriously. By using the App, you agree to the terms outlined in our Privacy Policy. Positeasy will only use your personal information in accordance with this policy.

Disclaimer and Liability

The App is provided "as is" without any warranties. Positeasy disclaims liability for any indirect or consequential losses, including economic loss, goodwill damage, or service unavailability. Your statutory rights remain unaffected.

If Positeasy is found liable for damages, the total liability will not exceed the amount paid for the App or associated services.

Service Suspension

Positeasy reserves the right to suspend or terminate any service with or without notice and will not be held responsible for any resulting inconvenience.

Advertisers in the App

Positeasy does not endorse or accept responsibility for advertisements within the App. Any disputes arising from third-party services should be resolved directly with the advertiser.

General Provisions

Positeasy may update these Terms at any time. Continued use of the App constitutes acceptance of the updated Terms.
Communication regarding your account will primarily be electronic.
These Terms are governed by Indian law, with exclusive jurisdiction in Bengaluru, Karnataka, India.

If any part of these Terms is deemed invalid, the remaining provisions will continue in effect. PositEasy’s failure to enforce any term does not constitute a waiver of that term.

Purpose of Outbound Communication

Positeasy may contact users for support, promotions, or service updates via calls or SMS. These communications will be made only after obtaining user consent.

Lead Collection & Storage

User contact details may be collected through website forms, sign-up pages, or inquiries and stored securely in our CRM or database. PositEasy ensures compliance with TRAI’s Digital Consent Acquisition (DCA) guidelines.

User Consent & Opt-in

By signing up or submitting their contact details, users explicitly agree to receive communications from PositEasy. Consent records are maintained and cannot be older than six months.

Opt-out Policy

Users can revoke consent anytime by contacting support or using the opt-out feature in messages.
